The plan is devised for a limited part of a territory of a rural municipality or a town, and it establishes the basic data for the construction activity planned for the upcoming years. Information about the initiation of a detailed plan shall be given via local mass media.<\/p>\n\n<figure class=\"wp-block-image size-large\"><img decoding=\"async\" width=\"412\" height=\"370\" src=\"https:\/\/arhpro.ee\/wp-content\/uploads\/2020\/08\/plaan.jpg\" alt=\"\" class=\"wp-image-544\" \/><\/figure>\n<p class=\"wp-el\">M\u00f5ned t\u00e4htsamad punktid Planeerimisseadusest detailplaneeringu kohta:<\/p>\n\n<p class=\"wp-el\">\u00a7 3. Planeerimise p\u00f5him\u00f5tted<\/p>\n\n<p class=\"wp-el\">(2) Detailplaneeringu koostamine on kohustuslik linnades ja alevites ning alevike ja k\u00fclade olemasolevatel ja kavandatavatel selgelt piiritletavatel kompaktse asustusega territooriumi osadel:<\/p>\n\n<p class=\"wp-el\">1) uute hoonete, v\u00e4lja arvatud \u00fcksikelamu k\u00f5rvalhooned, suvila k\u00f5rvalhooned ja aiamaja k\u00f5rvalhooned ning teised kuni 20 m2 ehitusaluse pindalaga v\u00e4ikehooned, ehitusprojekti koostamise ja p\u00fcstitamise aluseks;<br\/>2) olemasolevate hoonete, v\u00e4lja arvatud \u00fcksikelamu, suvila ja aiamaja ning nende k\u00f5rvalhooned, maapealsest kubatuurist \u00fcle 33 protsendi suuruse laiendamise ja selle ehitusprojekti koostamise aluseks;<br\/>3) maa-alade kruntideks jaotamise korral.<\/p>\n\n<p class=\"wp-el\">\u00a7 9. Detailed Plan<\/p>\n\n<p class=\"wp-el\">(1) Detailplaneering koostatakse l\u00e4hiaastate ehitustegevuse ja maakasutuse aluseks valla v\u00f5i linna territooriumi osa kohta.<\/p>\n\n<p class=\"wp-el\">(2) Detailplaneeringu eesm\u00e4rgid on:<br\/>1) planeeritava maa-ala kruntideks jaotamine;<br\/>2) krundi ehitus\u00f5iguse m\u00e4\u00e4ramine;<br\/>3) krundi hoonestusala, see t\u00e4hendab krundi osa, kuhu v\u00f5ib rajada krundi ehitus\u00f5igusega lubatud hooneid, piiritlemine;<br\/>4) t\u00e4navate maa-alade ja liikluskorralduse m\u00e4\u00e4ramine ning vajaduse korral era\u00f5igusliku isiku maal asuva, olemasoleva v\u00f5i kavandatava t\u00e4nava avalikult kasutatavaks teeks m\u00e4\u00e4ramine teeseaduses s\u00e4testatud korras;<br\/>5) haljastuse ja heakorrastuse p\u00f5him\u00f5tete m\u00e4\u00e4ramine;<br\/>6) kujade m\u00e4\u00e4ramine;<br\/>7) tehnov\u00f5rkude ja -rajatiste asukoha m\u00e4\u00e4ramine;<br\/>8) keskkonnatingimuste seadmine planeeringuga kavandatu elluviimiseks ja vajaduse korral ehitiste m\u00e4\u00e4ramine, mille ehitusprojekti koostamisel on vaja l\u00e4bi viia keskkonnam\u00f5ju hindamine;<br\/>9) vajaduse korral ettepanekute tegemine kaitse alla v\u00f5etud maa-alade ja \u00fcksikobjektide kaitsere\u00feiimi t\u00e4psustamiseks, muutmiseks v\u00f5i l\u00f5petamiseks;<br\/>10) vajaduse korral ettepanekute tegemine maa-alade v\u00f5i \u00fcksikobjektide kaitse alla v\u00f5tmiseks;<br\/>11) vajaduse korral milj\u00f6\u00f6v\u00e4\u00e4rtusega hoonestusalade m\u00e4\u00e4ramine ning nende kaitse- ja kasutamistingimuste seadmine;<br\/>12) vajaduse korral ehitiste olulisemate arhitektuurin\u00f5uete seadmine;<br\/>13) servituutide vajaduse m\u00e4\u00e4ramine;<br\/>14) vajaduse korral riigikaitselise otstarbega maa-alade m\u00e4\u00e4ramine;<br\/>15) kuritegevuse riske v\u00e4hendavate n\u00f5uete ja tingimuste seadmine;<br\/>16) muude seadustest ja teistest \u00f5igusaktidest tulenevate kinnisomandi kitsenduste ulatuse m\u00e4\u00e4ramine planeeritaval maa-alal.<\/p>\n\n<p class=\"wp-el\">(3) Krunt on ehitamiseks kavandatud maa\u00fcksus detailplaneeringu koostamise kohustusega alal.<\/p>\n\n<p class=\"wp-el\">(4) Krundi ehitus\u00f5igusega on m\u00e4\u00e4ratletud:<br\/>1) krundi kasutamise sihtotstarve v\u00f5i sihtotstarbed;<br\/>2) hoonete suurim lubatud arv krundil;<br\/>3) hoonete suurim lubatud ehitusalune pindala;<br\/>4) hoonete suurim lubatud k\u00f5rgus.<\/p>\n\n<p class=\"wp-el\">(5) Kuja on ehitiste v\u00e4ikseim lubatud vahekaugus.<\/p>\n\n<p class=\"wp-el\">(6) Detailplaneeringu koosseisus peab olema v\u00e4hemalt \u00fcks detailplaneeringu lahendusi illustreeriv joonis, et muuta planeering avalikustamisel ja otsustamisel osalejatele arusaadavamaks.<\/p>\n\n<p class=\"wp-el\">(7) Detailplaneering v\u00f5ib p\u00f5hjendatud vajaduse korral sisaldada kehtestatud \u00fcldplaneeringu muutmise ettepanekuid.<\/p>\n\n<p class=\"wp-el\">(8) Kehtestatud detailplaneering on aluseks uute katastri\u00fcksuste moodustamisele ning olemasolevate katastri\u00fcksuste piiride muutmisele detailplaneeringu koostamise kohustuse korral.<\/p>\n\n<p class=\"wp-el\">(9) Detailplaneeringu koostamise kohustuse korral koostatakse ehitusprojekt kehtestatud detailplaneeringu alusel ehitusseaduses (RT I 2002, 47, 297) s\u00e4testatud korras.<\/p>\n\n<p class=\"wp-el\">(10) Kohalik omavalitsus v\u00f5ib lubada, v\u00e4lja arvatud riikliku kaitse alla v\u00f5etud maa-alal ja milj\u00f6\u00f6v\u00e4\u00e4rtuslikul hoonestusalal, ilma detailplaneeringut koostamata:<br\/>1) t\u00f6\u00f6stusettev\u00f5tte krundil olemasoleva t\u00f6\u00f6stushoone laiendamist v\u00f5i selle k\u00f5rvalhoone p\u00fcstitamist ja selleks ehitusprojekti koostamist;<br\/>2) olemasoleva hoonestuse vahele j\u00e4\u00e4vale \u00fchele krundile \u00fcksikelamu ehitusprojekti koostamist ja p\u00fcstitamist, kui uue \u00fcksikelamu projekteerimisel ja ehitamisel j\u00e4rgitakse piirkonna hoonestuslaadi ja planeerimisp\u00f5him\u00f5tteid ning projekteerimistingimused koosk\u00f5lastatakse naaberkinnistute omanikega;<br\/>3) olemasoleva hoonestuse vahele j\u00e4\u00e4vale \u00fchele t\u00fchjale krundile korterelamu ehitusprojekti koostamist ja p\u00fcstitamist, kui uue elamu korruselisus ja ehitusalune pindala j\u00e4rgib olemasolevate hoonete vastavaid n\u00e4itajaid ja projekteerimistingimused koosk\u00f5lastatakse naaberkinnistute omanikega;<br\/>4) mitme hoonega hoonestatud krundi jagamist nende hoonete omanike vahel mitmeks krundiks, kui kinnistu jagamise sooviga ei kaasne detailplaneeringu koostamise kohustust tingivate hoonete ehitamise soovi;<br\/>5) muuta naaberkruntide piire, kui piiride muutmine ei too endaga kaasa nende kruntide senise ehitus\u00f5iguse, v\u00e4lja arvatud ehitusalune pindala, ja seniste kasutamistingimuste muutumist ning toimub naaberkruntide omanike kokkuleppel.<\/p>\n\n<p class=\"wp-el\">(11) Kohaliku omavalitsuse volikogu v\u00f5ib p\u00f5hjendatud vajaduse korral algatada detailplaneeringu koostamise aladel ja juhtudel, millele k\u00e4esoleva seaduse \u00a7 3 l\u00f5ikes 2 ei ole s\u00e4testatud detailplaneeringu koostamise kohustust.<\/p>\n\n<p class=\"wp-el\">(12) Detailplaneeringu koostamisel korraldatakse keskkonnam\u00f5ju strateegilist hindamist, kui see on n\u00f5utud keskkonnam\u00f5ju hindamise ja keskkonnajuhtimiss\u00fcsteemi seaduse \u00a7 33 l\u00f5ike 1 punktis 3 s\u00e4testatud juhtudel. Sellistel juhtudel peab detailplaneeringu koostamisel arvesse v\u00f5tma keskkonnam\u00f5ju strateegilise hindamise tulemusi.<\/p>\n\n<p class=\"wp-el\">[RT I 2005, 15, 87 j\u00f5ust. 3. 04. 2005]<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Devising of a detailed plan is the preliminary stage of construction work on a particular site.
